HSC 254.156 Disclosure
Only the information specified in Subsection (d) may be included in the mandatory disclosure statement, excluding any additional data. The facility is required to update this statement annually.
Even if a patient refuses or is unable to sign the disclosure statement, the facility must provide a physical copy to the patient and document the patient’s failure to sign in their file.
The facility must retain a copy of the signed disclosure statement provided under HSC 254.156 Disclosure until the first anniversary of the signing date.
No notice is necessary under HSC 254.156 Disclosure if prior to administering emergency healthcare services, the facility determines that the patient will not be billed for said services.
Compliance with Subsections (a)(1) and (d)(3) of HSC 254.156 Disclosure is attained if the facility displays its standard charges, including the specified fees, on its website in a readily accessible and legible manner, updating them annually or as needed to reflect current charges.
The failure to obtain the required signed disclosure statement from the patient or their representative under HSC 254.156 Disclosure may not impact the determination of liability for healthcare services provided by the facility.
